Without limiting Section 12 (Disclaimer) or Your obligations under Section 2 (Your Obligations), ENERUNI will implement reasonable and appropriate measures designed to help secure Customer Data against accidental or unlawful loss, access or disclosure.

You acknowledge that the Software and/or the Services are not intended for use with or for processing personal or sensitive personal information, protected health information, credit card numbers, financial account numbers, or other similarly sensitive information, and that You assume all risk arising from use of any such information with the Software and the Services, including without limitation the risk of any inadvertent disclosure or unauthorized access thereto or export. You are responsible for determining whether the Software and/or the Service is appropriate for its purposes, storage and processing of information subject to any specific law or regulation or any standard. ENERUNI, its Affiliates, partners or service providers are not responsible for compliance with any laws or regulations applicable to You or Your industry.

You acknowledge that ENERUNI will process a certain amount of your personal data, like IP address used to connect your computer to the Internet, full name, authentication details, etc. for the purposes of creating and managing your Eneruni account. The processing of this personal data will be carried out according to Eneruni Privacy policy available at https:/www.eneruni.io/privacypolicy

You acknowledge and agree that the Software is provided as cloud service hosted on third party cloud service providers' infrastructure (including supporting applications and databases) and utilizes third party payment processing service providers which may process Customer Data and any personal data included in Customer Data in accordance with their security and privacy policies necessary to provide the services. The information regarding third party cloud service providers and third party payment processing service provider utilized by ENERUNI or its Affiliates and their security and privacy policies or guidelines can be accessed from here https://www.eneruni.io/security.html on the Software Site. If 5.5 does not apply to the processing of personal data included in Customer Data You consent to processing of the Customer Data and any personal data included in Customer Data in accordance with security and privacy policies of such third party service providers. You understand that use of the Services necessarily involves transmission of Customer Data over networks that are not owned, operated or controlled by us, and we are not responsible for any of Customer Data lost, altered, intercepted or stored across such networks. We cannot guarantee that our security procedures will be error-free, that transmissions of Customer Data will always be secure or that unauthorized third parties will never be able to defeat our security measures or those of our third party service providers.

To the extent ENERUNI is a processor or sub processor of Personal Data , the Data Processing Addendum ("DPA") available at https://www.eneruni.io/terms/dpa govern that processing and forms part of this Agreement and Customer's use of the Software / Services constitutes instruction to ENERUNI for processing the Personal Data. To the extent ENERUNI Limited is a processor or sub-processor of Personal Data subject to the GDPR, the Standard Contractual Clauses attached as Attachment 2 to the DPA govern that processing and forms part of this Agreement and Customer's use of the Software / Services constitutes instruction to ENERUNI Limited for processing the Personal Data. Customer can download the signed DPA and keep a copy for its records.
